2. Your account

Some features need an account. You are responsible for keeping your login details secure and for everything done through your account. Give us accurate information and keep it up to date. We may suspend or close an account that is used in breach of these terms.

3. Products, listings, and the nature of live plants

We sell living plants. Every plant is photographed individually, and the listing photo shows either the exact plant you will receive or a representative plant of that type.

Because plants are living things, some variation is normal and is not a defect. Size, height, number of leaves, leaf shape, colour, and the degree of variegation will differ from the photos and will keep changing as the plant grows. We do not guarantee that the plant you receive will match the photos in these respects.

We try to keep listings, prices, and availability accurate, but errors happen. If we find an error in the price or description of something you have ordered, we may cancel the order and give you a full refund. See section 5.

4. Orders, pricing, and payment

All prices are shown in United States dollars (USD).

Payment is processed by Stripe on Stripe's hosted checkout page. Card payment is the main method. Stripe may also offer other payment methods it supports. We never see or store your full card details.

Placing an order is an offer to buy. Your order is accepted, and the contract is formed, only when payment has been successfully processed and we have confirmed the order by email. Until then we may decline or cancel the order for any reason, including suspected fraud, a pricing or stock error, or a destination we cannot ship to. If we cancel before dispatch, you get a full refund.

Any import duties, taxes, customs charges, or carrier brokerage fees imposed by the destination country are your responsibility, on top of the price and shipping charged at checkout.

5. Cancellations and refunds

• You may cancel an order for a full refund by emailing contact@nexusplants.com no later than 72 hours before the scheduled ship date for that order. The ship date is the date we have set for your order to leave our facility; export paperwork, phytosanitary inspection, and courier booking are arranged in the days before it, which is why the cutoff sits ahead of the ship date.
• Within 72 hours of the ship date, and once an order has shipped, it cannot be cancelled.
• We do not accept returns. Because the products are living and perishable, all sales are final once the order has shipped, except for the live arrival guarantee in section 6.

Approved refunds are made to the original payment method through Stripe.

6. Live arrival guarantee and damage claims

Every order is covered by our live arrival guarantee.

If your plant arrives dead, or is significantly damaged in transit, contact us at contact@nexusplants.com within 48 hours of delivery. Include clear photographs of the plant and of the packaging as received. We will provide a refund or a replacement at our discretion. Claims submitted after 48 hours, or without photographic evidence, will not be accepted.

Minor cosmetic transit stress, such as some yellowing, a bent stem, or a few bruised leaves, is normal for international plant shipping and is not covered. Plants generally recover with proper care.

Claims made after the window above, or without photographs, cannot be accepted.

The live arrival guarantee is the only remedy for the condition of a plant on arrival, and it replaces any other warranty to the extent the law allows. See also section 10.

7. Shipping, delivery, and risk of loss

Shipping terms, destinations, transit estimates, carrier handling, and export and phytosanitary documentation are set out on our shipping page at /shipping, which forms part of these terms. If anything in this section appears to conflict with the shipping page, the shipping page controls for shipping matters.

Delivery dates are estimates. We are not responsible for delays caused by customs, weather, or the carrier once an order has left our facility, though the live arrival guarantee in section 6 still applies.

Risk of loss or damage passes to you on delivery to the address you provided. It is your responsibility to give a correct and complete address and to be able to receive a time sensitive live plant shipment.

8. Import responsibility

We handle export compliance and phytosanitary certification from Thailand as described on the shipping page. You are responsible for knowing and meeting the import rules that apply where you live. If your country or state needs a permit, declaration, or inspection, tell us before you order so we can prepare the right paperwork. We are not responsible for plants held or destroyed by the destination country's authorities where you did not tell us about a local requirement.

9. Auctions

Some plants are sold through timed auctions at /auctions.

• A bid is a binding offer to buy that plant at the bid amount plus shipping.
• If you have the winning bid when the auction closes, you are obliged to complete the purchase.
• When an auction closes, we email the winner an invoice at the address on the account. Payment is due within 48 hours, through the same checkout and payment process as a normal order.
• If payment is not received within 48 hours, the sale is cancelled. We may relist the plant or offer it to the next highest bidder, and we may restrict your access to future auctions.
• Bids are binding and cannot be retracted once placed. An auction may have a reserve price, and if bidding does not reach the reserve the plant is not sold. The minimum bid increment, the starting bid, and the closing time are shown on each auction.

Except where stated here, auction purchases are covered by the same payment, shipping, and live arrival terms as ordinary orders.

10. Wholesale

Wholesale purchases are made through the separate wholesale portal and are governed by the wholesale terms provided during wholesale onboarding and approval, in addition to these terms. Where the two differ for a wholesale order, the wholesale terms control.

11. Intellectual property

All content on this site, including photographs, plant descriptions, text, branding, and design, belongs to NEXUS BOTANICA CO., LTD. or its licensors and is protected by intellectual property law. You may not copy, reproduce, distribute, or use any of it without our written permission.

12. Disclaimers and limitation of liability

The site and its content are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties that are not expressly stated in these terms, including implied warranties of merchantability and fitness for a particular purpose. The live arrival guarantee in section 6 is given expressly and is not affected by this paragraph.

To the fullest extent the law allows, our total liability for any claim arising from a purchase or from your use of the site is limited to the amount you paid for the order the claim relates to. We are not liable for indirect, incidental, special, or consequential damages of any kind.

Nothing in these terms limits liability that cannot be limited by law.

13. General

If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a term on one occasion does not waive it. You may not transfer your rights under these terms without our consent.

14. Governing law and disputes

These terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict of laws rules. Any dispute arising out of or in connection with these terms or your use of the site will be submitted to the exclusive jurisdiction of the courts of Thailand. Nothing in this section removes any mandatory consumer protection right you have under the law of your country of residence.
